Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://hypestats.xyz (the "Service"), operated by HypeStats ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

Some features of the Service require you to sign in using Google OAuth. By signing in, you authorize us to access basic profile information (name, email, profile image) from your Google account. You are responsible for maintaining the security of your Google account and for all activity that occurs under your HypeStats account.

3. Free and Pro Tiers

The Service offers both free and paid ("Pro") tiers:

• Free tier: Access to core features including wallet tracking (up to 5 wallets), ecosystem stats, projects, calculator, and HIP-3 overview.
• Pro tier: Access to all features including expanded wallet limits, leaderboard rankings, advanced analytics, and data export.
• Free trial: New accounts may receive a limited free trial of Pro features. No credit card is required for the trial. When the trial ends, your account reverts to the free tier unless you subscribe.

We reserve the right to modify the features included in each tier at any time.

4. Subscriptions and Billing

Pro subscriptions are billed monthly through Stripe. By subscribing, you agree to pay the recurring subscription fee at the rate displayed at the time of purchase.

• Recurring billing: Your subscription automatically renews each billing period until you cancel. You will be charged at the beginning of each billing period.
• Cancellation: You may cancel your subscription at any time through the Stripe Customer Portal. Upon cancellation, you will retain Pro access until the end of your current billing period. No partial refunds are provided for unused time within a billing period.
• Price changes: We may change subscription pricing at any time. Existing subscribers will be notified of price changes before their next billing period. Continued use after a price change constitutes acceptance of the new price.
• Failed payments: If a payment fails, we may suspend Pro access until the payment issue is resolved.

5. Refund Policy

Subscription payments are non-refundable. You may cancel your subscription at any time, and you will retain access until the end of your current billing period.

If you believe you were charged in error (e.g., duplicate charge, charge after cancellation), contact us and we will review your case.

Refunds will not be issued for dissatisfaction with data accuracy, completeness, or timeliness. As stated in Section 8, all data is provided "as is" for informational purposes only.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Scrape, crawl, or use automated tools to extract data from the Service
• Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems
• Interfere with or disrupt the Service or its infrastructure
• Resell, redistribute, or commercially exploit the Service or its data without our written consent
• Create multiple accounts to abuse free trials or circumvent account restrictions

We reserve the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

The Service, including its design, code, features, and branding, is owned by HypeStats and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

The Service aggregates and presents data from publicly available blockchain networks and third-party data providers. The underlying raw data is not owned by HypeStats and remains the property of its respective sources. Our proprietary value lies in the aggregation, analysis, calculations, and presentation of this data.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

We strive to provide accurate and up-to-date data, but all information displayed on the Service — including portfolio values, trading statistics, points estimates, fee calculations, and APY figures — is provided on a best-effort basis for informational purposes only. Data is sourced from third-party APIs and blockchains that may experience delays, outages, or inconsistencies beyond our control.

We do not warrant that the Service will be uninterrupted, error-free, or secure, nor do we guarantee the accuracy, completeness, or timeliness of any data. You should independently verify any information before relying on it.

9. Alerts and Notifications

The Service may offer optional alerts and notifications (e.g., position health warnings, liquidation risk alerts, price alerts). These are provided as convenience features only and are not guaranteed to be delivered in a timely, accurate, or reliable manner.

Alerts depend on third-party data sources and delivery systems that may experience delays, outages, or failures. You should never rely solely on alerts from the Service to manage your positions or make financial decisions. It is your responsibility to independently monitor your positions at all times.

HypeStats shall not be held liable for any losses resulting from missed, delayed, or inaccurate alerts.

10. Not Financial Advice

Nothing on the Service constitutes financial, investment, trading, tax, or legal advice. The Service provides data and analytics tools for informational purposes only. You are solely responsible for your own investment decisions. Always do your own research (DYOR) before making any financial decisions.

11. Limitation of Liability

To the maximum extent permitted by law, HypeStats and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or funds, arising from your use of or inability to use the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

If you are using the Service on the free tier and have not made any payments to HypeStats, you acknowledge that you are not entitled to monetary damages of any kind. Your sole remedy shall be to discontinue use of the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time by contacting us.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.
